It is quite simple, Article 3 Section 3 reads
So those that protested our fight against the Christian rulers in Boznia were giving comfort to the enemy and guilty of treason? Who do we limit the freedom of speech, just those in uniform? Having joined the military during Viet Nam and not being a believer in the national policy when I joined; having written college papers supporting the idea we took the wrong path in Viet Nam starting at the end of WWII; did that make me guilty of treason?
No, not unless you committed an act of war against your fellow soldiers in the Nam. and or on a base located in Texas. Instead of 13 counts of murder Hasan should be tried for one charge of High Treason and executed.
The Next trial should be for those who ignored his Jehad rants and transfered him to Ft. Hood. Those who died and were wounded were victims of Political correctness. Which is coursing through our vains like a desease in America.

On the point of a trial for High Treason because of the shooting I have no problem however I think the murder counts will do just fine and he can go find his place in hell when it's all over along with those going on trial in New York. As to those that ignored his political rants, not enough information yet on this but those that ignored his multiple communications with a known terrorist I have a major problem. Worse, those that as a mater of routine ship off a poor performers to other locations to inflict their bad work on those of "lesser importance" to avoid the hard work of dealing with the poor performer need to pay the cost for their poor decision making. This is not unique to the military, hospitals often pass on bad doctors to other hospitals with good references just so they are rid of the problem. Not to down play the horror of the shootings but the practice of passing on poor performers in the medical profession has killed more people with shoddy medical work than the bullets shot by this poor excuse for a doctor, officer, human. It is the root of how this occurred and this practice in dealing with those we trust with our life needs to stop.
I agree with swingtide. The issue is deeper, and holding him up on high treason does not prevent the next incedent. We need to look at the flaws in the larger structure to figure out why it happened.
