Have you ever had something done to you, or seen it done to someone else, that just doesn't seem right?

Such as:
I was involved in a motorcycle accident about 9 months ago. Someone ran a stop sign and made me put my bike down. I broke my collar bone in 3 places, and tore my shoulder up inside. Seven months, shoulder surgery, physical therapy, $21,000 in med bills, the loss of my job, and a totaled bike and all the insurance companies want to give me is a total of $64,000 to cover all of that plus my lawyer, missed wages and everything.
Now think of this. A guy walks onto an airplane with some kind of writing on his shirt that was deemed offensive. He was asked to turn his shirt inside out or leave the flight. He sued and was awarded something in the millions of dollars.
I was laid out in the middle of the street, went through the pain of broken bones, surgery, and physical therapy, the loss of my livelihood, not to mention my bike.
This guys pride was hurt and he gets millions. My life is changed because someone didn't want to wait 30 seconds and I get what amounts to a few thousand.
So tell me, is it right, or is it wrong?

Go ahead and add your story.
Because the Judicial district you live in is conservative. They are much more concerned with protecting the corporations than the individual. I was struck by a semi on the freeway. I suffered a head injury, cervical spine injury, lost teeth and was medically discharged from the military after 14 years of service. I lost my retirement, a year of combat pay and benefits in Iraq and I suffer from life-long disabilities. I didn't even personally recover the amount of military pay I lost. My attorney told me that Juries from conservatives states usually return numbers that are very very cheap and unfair, while liberal states usually have ridiculous awards. Where is the fairness in all this?
aahhh the joys of our legal system useless suits get millions while legit suits get crap!
male here knows what your goin through 20 years ago 20year old drug dealin drug addict scum ran stop sign and damn near killed him, he lost kids, business, money, home , basically life as he knew it to be disabled, have numerous surgeries that are now not totally payed for ... pretty much screwed for rest of life .. and got 1.3 million settlement but after paying off every one was left with bout 300 thousand for rest of his life to take care of him and his 5 kids he was 25 when accident happened
it sucks!
so no it is not fair!
What gets me is the lady that ordered hot coffee at McDonalds and spilt some on her and sued the corporation for millions. If you drink coffee, you know it's hot! Now the coporation has to put caution hot on the Hot cups! Ever time I see it, it makes me feel stupid! Isn't it common sense to know! lol

As for you, SWINGINGEAGLES, I wish the best of luck with the recover! it takes alot of guts to get out on a bike now adays! And it's wrong that people such as yourself get so little and people with the sue happy attitude get so much more.
I was in 2nd grade when my father was in a motorcycle accident. A 19 year old college kid ran a red light and t-boned into my father who was making a left hand turn on a green light. He flew on to the top of the kids suburban and the kid slammed on his brakes. my dad hit the hood and fell to the ground...it was two hours after the police arrived that they realized my father was still alive. and it took them another hour to get him across the street to the hospital. Now he had a pre-existing condition of Chronic Fatigue Syndrome, which only got exponetially worse after the accident. They had him in the ICU for 8 weeks before moving him to a different floor only because they didn't have a bed for him anymore.

At his better days he was sleeping 16 hours a day and could not hold down any type of a job. My mother on a school teachers salary had to raise 5 kids without any help beside the small SS she got for the kids. She didn't qualify for anything because she was married and made barely too much. She lived like a single mother, but had to come up with money for my dad's expensive medical bills...and there was no help....It doesn't ever seem to be fair....
some kid killed my father in law but due to weather and road conditions he was found not liable. now i was a trucker a lady coming out of the fog on black ice loses control hits me lays me up for a year with a broken hip. dot and highway patrol both say due to weather conditions 5 mps was to fast. and said the fault was not mine. oh also she was an illegal alien. she won 500,000. i got fired and still cant find a job
yeah for fair

Liberal or conservative doesnt matter it is what they are allowed to give, a jury has nothing to do with statute monitary limitations in any state. Remind me not to have an accident in Utah...LOL Get a new lawyer.According to him you already lost.

No, according to the studies they use to value the case it has everything to do with conservatism vs. Liberalism. Liberals are more liberal with the money. The numbers don't lie. ;)
we were involved in a crash about 2 years ago. we were rear ended at a dead stop by a drunken illegal who was going about 40 mph...he then fled the scene and was later found.
he didnt have insurance....but had a drivers license...go figure...we got nothing...zero...nada...he got 120 days in jail...for dui driving while uninsured fleeing the scene of an accident with injuries and driving without a license...best part...they didnt even deport him..no visa no problem...gotta love this country...it protect non tax paying illegals more than its own citizens.

You can thank all those capitalist corporations hiring them for cheap labor instead of citizens. The fault lies with the one dangling the carrot. Do you blame the rabbit?
We were with another couple having a real good (naked) time. I had just given the other female some of my best oral (which she responded to quite nicely) and the wife was also giving some of her best oral to the male. However, apparently it was to good since all the sudden the other female started "unpacking her baggage", so while I was calmly "running her baggage through the x-ray scanner" to see if we could "board the flight" together, my wife and the male half were having a hell of a good time. When they finished up and came to see what was going on, the female "baggage carrier" finally went ballistic as we found out it was the first time in a very long time that her male companion was able to get... aaaaa - so aaaaaa "ready for boarding his flight". - They left in haste and I got nothing! Damn I hate airports. ;)

Not trying to belittle any body's shitty experiences, which we we're very saddened to read - sorry guys.

TR wrote "No, according to the studies they use to value the case it has everything to do with conservatism vs. Liberalism. Liberals are more liberal with the money. The numbers don't lie." Which studies and what Numbers? When you purchase your insurance the amount of liability is in your policy, you get what you pay for. States, every one have limitation on cash awards. In particular auto accidents and work related injuries are bound by law to pay X amount per injury and or death. The jury has no say in what they can award. I sued for an accident and received the max amount the state would allow and my lawyer got the state allowed 33%, if anyone is to blame it is the lawyer that receives that amount. The judge stated the max amount of award in this case is $160,000. And this was recorded in to the case. Where we went to court was St. Louis County very conservative. Again I would love to place blame on the jury but I cant I can only blame loose laws that govern what a lawyer can make in any case.

According to the studies the attorney's use to determine the acceptable settlement ranges. They take an average of similar cases over a 3 year period and that's the formula they use to determine what an average jury will give you. It's called "Jury Verdict Analysis". Look it up. The numbers don't lie. Juries in conservative states give less money in the awards. It goes hand in hand with the "Protect the corporation, fuck the little guy" mentality the right has.

I am not talking about insurance caps. The trucking company that hit me covered their own insurance at over 5 million. I was awarded 215k and walked away with 56k and a permanent spine injury (triple level cervical disc herniations), Brachial Nerver damage, broken teeth and permanent memory problems. The figures here were totally based on Utah having conservative juries. I was told this by more that one attorney and a couple of lawsuit funding agencies. I think I will put a little more weight in what they say. Show me your law degree and I might entertain your contradictory input on this. I've been there.
I got the best attorneys in the state, they snapped it up. The process needs to be federalized. I think there needs to be a bottom cap as well. I don't think you should walk away with anything less than all your medical expenses paid for the extent of the injury. All your back wages paid. I also think your attorney's fees should be covered as well.
Again freeride, I just spend three years learning the process. You're talking out of the side of your head. That's how ignorance works. You don't know what you're talking about, so you're just flapping your gums trying to protect your own pride. That's ok. I will allow you to believe what you want. The truth is. The juries in this state are more conservative with their awards than they are in other districts. IT'S BEEN PROVEN!!! I have seen the numbers and the literature is on my side... you have your hot air. That's ok with me. I know the truth.

Am I saying this is always the case? No! There are always exceptions to the rule. However the vast majority of ruling in conservative states favor the corporation.

[color=#090d49"][i]"Economic damages can be pre-determined. The remaining costs have variable values. Emotional distress damages are contingent upon proofs and the value that juries in the adjudicative forum place on emotional distress. A conservative jury pool is likely to award a plaintiff substantially less in emotional distress damages than a liberal jury pool. Similarly, attorneys
We are talking about both. Verdicts derived from conservative jury pools tend to be less on the side of the victim/plaintiff and more on the side of the business/defendant. It's pretty simple the numbers don't lie. The attorney's fee is fixed and agreed upon in the beginning. I knew what my attorney was taking the whole time. I knew what the doctors were taking. It's the fairness of the jury that hinged what I was taking.
