Should Prostitution be illegal? Please give an elaborate response. I am curious of your answer and how it came to be. Please take your time a give your opinion.

Prostitution dates back to at least 2400 B.C.

Prostitution is illegal in the United States except for 11 rural counties in Nevada.

On Nov. 2, 2004 two prostitution referendums went to the voters in the U.S. with 63.51% of voters in Berkeley, California wanting to keep prostitution a crime and 62.78% of voters in Chruchill County, Nevada wanting to keep prostitution legal.

The same brothel in Nevada could cost an owner a $200 fee in Lander County, a $150,000 fee in Nye County, and up to 6 months in jail and/or $1,000 fine in Las Vegas.

Rhode Island has no laws prohibiting the owning of a brothel if the owner doesn't receive the proceeds from prostitution.

In 1751, Holy Roman Empress Maria Theresa banned short dresses and replaced waitresses with waiters to suppress prostitution.

Researchers have identified at least 25 types of prostitution by location (street, brothel, etc.), solicitation (CB radio, newspaper ad, etc.) and and/or sexual practice (bondage, lap dance, etc.).

In Sweden selling sex is legal, but buying sex is illegal.

In Japan prostitution is illegal, but selling non-coital sex acts is legal.

Prostitution is criminalized, legalized, and decriminalized in Australia depending on the state.

In 2004 the number of U.S. prostitution-related arrests ranged from California's 14,506 to Vermont's 3.

Proponents of legal prostitution have included Ann Landers, the ACLU, and The Economist while opponents have included Ronald Reagan, Hillary Clinton, and Susan B. Anthony.

Medieval canon lawyer Johannes Teutonicus, when defining prostitution, suggested that a woman who had sex with more than 23,000 men should be classified as a prostitute, although 40 to 60 would also do.
PRO: "It is estimated that if prostitution were legalized in the United States, the rape rate would decrease by roughly 25% for a decrease of approximately 25,000 rapes per year...."




CON: "Prostitution cannot eliminate rape when it is itself bought rape. The connection between rape and prostitution is that women are turned into objects for men's sexual use; they can be either bought or stolen. A culture in which women can be bought for use is one in which rape flourishes[.]"
Rape is unconsensual sex, usually by force, though not always. Prostitution is consent given with payment. The women are not being forced, tricked or drugged. HUGE DIFFERENCE! Rape will not flourish, where do you come to that conclusion. Back it up with reason and not just something you are saying. You also contradicted yourself saying in your "PRO" that the rate of rape would decline by 25%, if it were legal and it would prosper in your "CON".

Now, the definition you gave also applies to swinging as you are being "used as a sexual object" in this lifestyle as well. So you are saying that swinging also equates to rape. I totally disagree with your foundless claims.

We think that is should be legal because we don't see naything wrong with prostitutes making money the same way a business makes money. Prostitution is a business in our minds and in reality it is already happening.

we agree with j3109 .. if it is a way for them to make money it should be no different than any company... they should have to purchase a lic. to operate and go monthly to be checked for any std and aids or whatever else ... and if found with anything the lic. to be revocted

Exactly. The 1st Amendment was written to protect us from government imposed religion.
In no way do I condone the work of prostitutes or anything affiliated with prostitution, but it should be legal, and there are countless reasons why. I hypothesize that several problems would subside if prostitution were legal: overpopulated jail systems, domestic violence, high rates of cocaine use, rape and rampant spreading of HIV/AIDS.

Currently, it is assumed that as much as one-half of a typical urban city's prison female population are prostitutes. In fact, Los Angeles alone spends close to $100 million annually dealing with illegal prostitution. The real cost, of course, is that these public resources could have been used to protect citizens from real criminals. Taxpayers are spending large amounts of money on non-violent prostitutes that cause little -- if any -- public unrest. There are hardly any distress calls to the police for someone having sex for money in a hotel or in a private residence. The only way these women are busted is if cops trick them.

According to the Future of Freedom Foundation, "In Newark, New Jersey, the estimate is that close to 60 percent of all prostitutes carry the AIDS virus. Yet, in the relatively 'free market' of Nevada, where prostitution is legal, not one [as of 1989] of the state-licensed prostitutes has ever tested positive for AIDS."

If prostitution were legal, it would be mandatory for prostitutes to be tested for STIs, and it would force them to have safe sex so they could keep their jobs. Measures would be drawn up to protect employees (prostitutes) from sick clients (johns).

Prostitutes obviously live an illegal life-style, so they have no legal protection. They are vulnerable to rape, domestic violence and high use of illegal narcotics. They are more vulnerable to these vices because they are not protected under laws. So pimps and johns openly beat and/or rape these women without sympathy. Many of these women feel as though they have nowhere to go, and this results in their turning to prostitution as employment and then using drugs to bury the pain of being a prostitute. The United States remains one of the few countries with laws against prostitution. In other nations, criminal laws seek instead to deal with the social problems of prostitution through control of public solicitation and restriction of those who would exploit prostitutes. Decriminalization would free the courts and police from handling victimless crime, allowing these forces more time to deal with serious violent crime.

Prostitution is the oldest profession in history and no matter its legality, it will always be here. Since it will always be here, why not try and protect the citizens of the United States who will solicit contracted sex no matter its legal status? Why not protect innocent women whose men go out and contract sex, putting these innocent women at risk for disease? According to the U.S. Department of Health, prostitution accounts for about 3 to 5 percent of sexually transmitted diseases. That is not much.

I am sure that figure could be minimized, if not eliminated, with the legalization of contracted sex.
That is my argument against drugs too. Our people will continue to run their faces into brick walls because, "GAWD says it's wrong". Perhaps these hypocrites should quit deciding for everyone else, like their bibles teach and worry about themselves. My two cents.

I belive that it should be legal every where, I live in elko county nevada, it is legal here, there are very minimal violant sex crimes, rape being one of them, there are rules and regs that gp with them.
1. have to be outside city limits
2. ID required-everyone no matter of appearances
3. safe sex is required
4. weekly testing of the girls
5. income is taxed
those are the standard laws, there are others but these are the important ones.
I know in the local houses showers are free and mandatory, food is free and the booze is as well.
I personally have never been a patron of one, I do however have several that are my customers (houses and the girls that work them) they are just like the rest of us humans and they are usually very nice and polite- they will answer any questions you have.

Anyone that reads me already knows my answer. LOL! I am for legalizing it. I would not personally partake, because I don't need to, but I think it should be legal. I also think drugs, gambling, gay marriage and a lot of other things should be tolerated. These are liberties that were unconstitutionally (1st Amendment) stripped from us by religious people trying to legislate their dogma. I am all for self-imposed abstinence, but don't try and force others to follow your moral code.

The only laws that I think that are trully necessary when it comes to crime, are those that prevent you from directly or inadvertently, adversely affecting someone else. It doesn't mesh with society and you are taking someone elses choice. These crimes include, but are not limited to, Murder, Rape, Theft, Robbery, etc.

Now all the things I mentioned that should be allowed, also should be regulated to prevent others from inadvertently partaking against their will, but it still should be up to the individuals free will. After all, even the bible teaches that one.

Don, I wholehaertedly agree on your stance via 1st amendment rights, and agree that it should be legalized along with most drugs! It would be great for the economy!!!
My personal opinion on prostitution its self is: if you can't get it without paying for it, you probably don't deserve it!

If you forcibly have sex with a prostitute, is it rape, or shoplifting???

You are paying with your labor either way. You get compensated for your job with money. You get spend it, you get laid. One just has less commitment than the other. You actually pay with your soul when you get married HAHAHAHA!

When you date a woman, you take her out and spend money on her with the hopes of getting down her pants. Prostitution is actually cheaper in the long run and less stressful, to say the least. LOL!

I did as it was suggested and did a little research and found this site http://www.non-trivial.com/f_pro.htm . I agree that if it was legalized that it would stop alot of illegal things that are going on. As with anything the goverment has not figured out how to stop all the illegal acts and make them pay taxes yet. Just like 'Shin in the south, still can not stop it and you can get it anywhere but now you can get a stamp to make it legal as long as you pay taxes on it and do not sell it. It has it's down falls but if it was legal they could keep alot of the bad out of it and make it safer for the girls and guys alike. I have a friend that was busted working for an escort service and when she went to court and the judge ask her why she was doing it she told him "You won't make my Ex pay his child support, So, I have to make money the best way I can, So in part your honor it is your fault that I am hooking so my kids can eat". She got an extra 15 days for contempt but said it waas worth it. Check out the site it has a little info that makes sence. Thanks Troy

While making prostitution leagle would take a lot of social sting out of the act and then maybe adults will be alowed to be adults. Here are a few fact that people ignore. In denmark where prostitution is leagle sex crimes and STD's have gone up. When a lady or man gets a positive test their lic. is revoked does that mean they stop working the trade. NO it just means they can no longer do it leagly. And since when has breaking the law stoped anyone from doing what they want, look at Utah sodemey laws. Great Brition, Denmark, Switzerland, and a few more leaglized drugs. Did that stop illeagle drugs or crimes for drugs. No it went up, dont belive me ask sid vicious. In Japan any illeage drug is punishable by death once convicted no appeals crime went down.
Now with that being said. I think both should be leaglized and better control on both. I also think the current tax system should be abolished and a new 25% sales tax. so all money spent is money earned and taxed. Food would be taxed at 10%.
Now if only the locals would remember what Joseph Smith said in response to why the 4th largest city in the nation only had 1 full time officer, " I teach them correct princaples and let them goveren themselvs."
From the time that men and women started acquiring personal posessions, prostitution has been around. Women have long known the power of their vaginas. Should it be legal? Absolutely. While I don't have exact figures I have the conviction that if legalized, regulated, and taxed appropriately there would be a reduction in certain types of crimes and instances of STDs. There would need to be some sort of fund set up so that if a prostitute were to be found with an incurable STD, they could recieve the necessary training to find work in another field, thereby removing the bulk of the cases where a diseased sex worker spread the disease unchecked. By the vocation being legalized, teen girls would not get forced into it, or at least not as easily. How could they? You would have to apply for a lisence and that process would require some way to verify age and identity. (of course if prostitution were to be legalized, what incentive would women have for giving it away anymore? Why give away for free what you could charge for and make the rent with?)

Now some people have mentioned that legalized prostitution would also reduce the illegal drug trade. I can only see one way that the illegal drug trade can be conquered, that is through one unified Global Government. If you can't control the areas where the drugs are grown, manufactured or otherwise produced, you will never be able to completely get rid of the entire trade. Now if we had that kind of structure in place then by all means legalize the drugs. Make them available in certain areas of every major metropolitan area and only within those areas. Make sure that anyone taking these drugs has someway of being monitored to prevent people from overdosing or completely destroying themselves.

If both these got legalized and properly regulated on a global level we could very easily pay for all sorts of public works projects. Maybe we could even do away with private health insurance entirely. (now that is topic I don't think anyone wants to get started...LOL)
