As many of you know opn and off premise clubs and patrons across the nation are being targeted by both religeous and state groups. In some cases partons are being outed to their families, neighbors and in many cases to their entire communities resulting in loss of emplyment and even worse attacks by various child protective agencies.
Therefore I would like to open a discussion up on how someone might get the ball rolling to at least introduce legislation (even at a county/city level) making these clubs, both commercial and private, legal.

If you are outed defamation of character, as well as, slander with intent comes to mind.

Not being a lawyer and living in the bible belt, charges of prostitution and running a bordello comes to mind. Most homes that would be opened to swinging activity, and clubs houses, hotel/motels that would willing allow such gathering would be investigated and charges of the above mentioned would be brought. Not to mention the problems with departments of families, etc.
While it is a wonderful idea, it probably will have way to many problems.
If donations or membership fees are charged to cover expenses, the above will especially come into play.

Nope, the truth is a clear defense for defamation. You can only sue for defamation, slander, and/or libel if the statement is untrue.
As for legalizing swinging, it already is according the Supreme Court. We had this discussion a while back (jump in anytime TR) but the Texas case basically said, what happens between consenting adults in the privacy of their home for sexual relations is non-judicial.
Now, if the other people involved pay to get access to your bedroom, then there are issues since a business license is a totally separate matter.

No one wants to be outed. Most people don't care what you do with your sex life unless it is your ex's wife. She threatened to tell everyone what we had done in our lives. So, I took her power away and told everyone first. I am not ashamed of my life or the way I chose to live it. The people that really care about you will not like it but will let it go. Anyone that holds that against you isn't worth being friends with.
I honestly dont think it's anyones buisness or place to say wheather what you are doing is right or wrong. It's your life.. and if your doing it with someone or people you know and care about whats the big deal. your not harming anyone, as long as it's safe and ppl get tested for STD's (wich everyone should in this lifestyle) then there is no harm being done
