I live near that hospital and have seen how it works a few times. A pregnant woman who is hemorrhaging has to wait 12 hours in the waiting room to get in the ER while at the same time a teenager who skinned himself up abit skate boarding and just has a few scrapes that aren't bleeding comes in after the woman yet enters the ER hours before...... figure that one out.
Go to Sand Lake Hospital which is just a few miles away and ER admittance is immediate. Makes no sense.

I agree people over react, but this is pretty straight forward. Woman goes to the hospital to have baby, woman wakes up missing limbs. All she knows is she was infected by a a fleshing eating strain of strep. She wants to know the details of the situation and the hospital is not divulging. I think you have every right to know about any medical treatment... <b>EVERY SINGLE DETAIL!</b>
What do the doctors have to gain by preventing her from gaining access to the information??? The doctors have time to build a defense against malpractice litigation. They are buying time. You can call it conspiracy theory. I call it damage control.
Granted, infections are a risk during surgery, but negligence could have been a factor in this case and the woman should have the right to view any and all documentation regarding the treatment for her investigatory purposes. Let me ask you this... Why would they not let her have access or tell her anything regarding the surgery??? There is no excuse.

HIPPA only applies to a third party trying to access you records. You, as the patient, have full rights to access your own medical record. Florida, where this happened, has special legislation in place to prevent the hospital from doing what it's attempting to do. This was mentioned in the video.
I think it's very likely the quadruple amputation saved her life. However, I think the hospital has no right to keep documentation regarding her treatment from her. Period.

Letting the hospital hold the material for analysis is unacceptable if it violates her rights to access. When you have the right to something it's not at the hospital's fuckin convenience (30 days to be exact). I'd go to the records department, show my ID and say let me see my fuckin record. PERIOD!

well i normally dont get too involved in these things but i do work in a hospital in florida and do particularly work in information security and am hippa certified. hippa was made to set a standard for sharing phi (protected heath information) with insurance companies and other nessasary third party entities. in no section of the hippa privacy act does it say the patient shall have no access to thier medical record. they should provide the records to the patient and advise any personnell that she came in contact with during any contagious periods that they should be examined. cover ups and burying information is never the standard operating procedure. if they refuse to give the records she will need to get a court order for thier release. just my thoughts.
all that hippa did was make it easier for law enforcement, courts and insurance companies to look at peoples records,
well stated ally. you are correct law enforcement does require a warrent to get the records. she should look into the americans with disabilities act and see if there are any items in there that would require the state to give her assistance incareing for her newborn child.

Fill out your allergy information, to have the nurse give you EXACTLY what you are allergic to, then say they don't know what's wrong with you. Not that anyone is pointing fingers, but by telling patients to either, "get over it" or "don't worry, your records are safe and will be released through court, but we took care of you right? You're alive after all!" and oh "We know you are who you say you are (how many cases of women having babies and getting a flesh eating bacteria can a hospital really have?) but we have no REAL idea this is you" is just not smart. I'm sure nobody in America voted to have their own records held from themselves. It is possible, though a I think after reading THOUGHTGARDEN's educational post. I think it's more likely not the case. It was most likely a natural cause and the doctors did what was neccessary to prevent her death. However, she still has every right to hear details of what went wrong. The "Right-to-know" act that was passed in her state the year before coupled with HIPPA should ensure that. The fact that her attorney has to sue the hospital to get a judge to interpret a law that is already established for this reason is a joke. What part of Right-to-know is unclear?

Yes it is a eye opener and very sad and i guess we should read thing better. With less then two months till I go in for the same thing I trust that where I am going is a safe place and hope that my Dr and all of them there are up frount with everyone they see. I know thing can happen. And Jared doing what he done for his job would know better then all of us what goes on in that little room. Your not safe anywhere you go but there are people trying to make it that way.
