Unfortunately stupid law suits DO happen. My shop was sued recently for replacement of A new car.
The "customer" came in at 4:55 pm (closing is at 5 pm) and said " I just put my spare on my car but couldnt get this one lug nut on. Could you put it on for me?"
Ok you think ONE lugnut . Put it on tighten it check the torque and go on right?
WRONG!!!!!!!
Two weeks later we get a call from an attorney to advise us we are being sued for 45,000.oo (fee for replacing a Kia Rio) and medical cost.
We go to court and during trial proceedings and all the shop was closed for 4 days ( means no money coming in , no repairs completed)
Our attorney simply stated that since we were being sued for not putting on ONE lugnut properly , then what happened to the other lugnuts?(that we didnt touch)
We won our side of the case but when we tried to countersue for loss of wages and attorney expenses the judge,the courts, AND the law states we cant countersue for any of these losses when defending the honor of our business.
Long story short (too late) We got sued for putting on one lugnut.
The guy went 22 miles and while going around a curve in the roadthe wheel broke off and he totaled the car.
Doesnt matter that he had no license , no insurance, and btw an officer trying to pull him over for speeding saw the accident.
So attorneys will try to sue for anything no matter how frivulous.
