nation, the factors evaluated by the courts are whether parental
contact "is in the best interests of the child." To do this, we need
to show that participation in the Lifestyle, in and of itself, does
not make anyone a bad parent.
There are only a few formalities. Under Florida Law, Rule 4-1.8(f) of
the Rules Regulating the Florida Bar governs "Compensation by Third
Party," and allows for parties unrelated to the litigation to pay
fees and costs on the clients behalf.
The Rule states:
Compensation by Third Party. A lawyer shall not accept compensation
for representing a client from one other than the client unless:
1)The client consents after consultation;
2)There is no interference with the lawyer's independence or
professional judgment or with the client/lawyer relationship; and

Gee I wonder how the ex husband intends to prove her lifestyle choices? Subpoena couples/people she has "been with"? That would certainly upset people who wish to remain discreet as all this would be public record.
If it came to a choice between being in the lifestyle or losing my children, I would give up the lifestyle and never look back. Understanding that past activities still weigh in, but even people who are alcoholics who have stopped drinking do not always have their custody taken away based on their past actions. If she got out of the lifestyle and say went to a "sex addicts" group and showed she was willing to "cure" her urges, it might go a long way in the court.

We don't get the stupid and ridiculous laws in this country. We are glad that we move back to Germany soon. We are tired of all these laws and "no do's" - especially here in UTAH.
And what is this anyways? We thought as soon as you are an adult, you can do whatever you want -on a legal basis of course- and chose your personal "way of life". Why does the American government always try to mould mature people???
Maybe someone out there is able to answer these questions for us....

I can understand peopl getting upset IF what the parents do is detrimental to a child's welfare. But to use what a person does that does not affect the child; the child has seen nothing, or nothing untoward has been said around or to the child nor done around the child...is chriminal in it's own right...IMHO. As for the government getting involved in moral issues or ethical issues or the churches getting involved for the same reasons is absolutely ludicrous. Look at the politicians in DC and maybe in your own city or state.... The scandals and the people who are getting indited. How many of these religious leaders, ministers and priests are getting caught with their pants down or their body parts where they don't belong.....

I hope that the defense lawyer finds a good number of skeletons in the plaintifs closet and puts this whole issue to rest. While not the same impact, a Sherrif in a small town was, while trying to get re-elected got national coverage in NC over a swing club. People were exposed and the owners had to take their child out of a private school and put her in another school in another state because of the publicity.

This case has nothing to do with setting a national precedent. It is simply a bitter divorce dispute. They are just throwing mud back & forth. When you go into any legal battle you go in with the idea you are going to absolutely knock them out, no holds barred. It is the only way to win.

Bravo UTCPL well said we all need to choose our battles this one although somewhat disheartening for the individuals involved is as stated a somewhat bitter divorce case which will be handled in the juristiction of Florida under Florida domestic laws. Child custody has gone through many iterations in many venues and juristictions and has in most cases been found that outside behavior of an individual which does not directly involve the child does not determine the ability of the parent to maintain an equitable and loving relationship with the child and therefore does not taint the ability of the individual to be a good parent Although the ultimate decision lies in the hands of the judge (if he is a wise judge he will allow the experts to resolve this, experts meaning the two lawyers) he will be the last say though and if he hasn't gotten lucky in a while he might not be willing to have compassion. But who knows! Lady Justice has that blindfold on for a reason. If this womans husband as I understand it is an attorney and he is defending himself well, as Ben Franklin so adiquately said it...."A man who represents himself in a court of law has a fool for a client" .....and there you have it. We wish this couple much luck and in any case hope the best for the children and there relationship with both parents.

i have a limited knowledge of the legal system however i do know that in order to remove custody you have to PROVE that there was wrong doing or that the child was in danger. in danger of what is up to interpretation.
i don't see how anyone, engauged in the lifestyle on a casual basis, aside from having sex in front of there children could be causing any harm, however.....
i have seen delta dawn in the past, and i have read many of her posts as well. while we know near nothing about her, we have heard many hints and allegations of prostitution on her behalf. mainly due to the fact that she organizes gang bang parties very openly on some swing sites and then charged men to attend? thats not too smart if you asked me, and especialy not smart if you have an attorney for an ex-husband. the rest of this sounds like a bunch of leagal mumbo jumbo, and for those of us that are just casually in this, i doubt we have much to worry about.

This is something that is very upseting to all of us. We truely feel sorry for her and any other people that have to go through this. But look at it this way with enough money money in our court of law O.J. can get off that shows us exactly how worthless our judicial system really is . We agree though, our children come first before all else.
